Terms of Service
Welcome to http://www.chinatransinfo.com (the “Site”). China TransInfo Technology Corp. (“China TransInfo”) provides its services to you subject to the following conditions. Before you may use the Site, you must read and accept all of the terms and conditions in, and linked to, this Terms of Service (“Terms of Service”) and the linked Privacy Policy. We strongly recommend that, as you read this Terms of Service, you also access and read the Privacy Policy. This Terms of Service is effective upon acceptance for new users. If this Terms of Service directly conflicts with the Privacy Policy, the Terms of Service will control for the purposes of usage of the Site. If you do not agree to be bound by this Terms of Service and the Privacy Policy, you may not use the Site in any way. Use of the Site shall constitute agreements to the Terms of Service.
1. Website content.
In the Site, China TransInfo provides users with descriptions of China TransInfo’s services and certain other information (the “Content”). You are responsible for obtaining access to the Site, and that access may involve third-party fees (such as Internet service provider or airtime charges). In addition, you must provide and are responsible for all equipment necessary to access the Site.
2. License and Site Access.
China TransInfo grants you a limited license to access and make personal use of the Site and the Content solely in accordance with this Terms of Service. The scope of this limited license does not permit you to, and you agree that you will not: (i) collect, download, copy or use Content for the benefit of another vendor or any third party; (ii) link to any internal or subsidiary pages of the Site located one or more levels behind the main page (“deep linking”); (iii) upload to, post on, or transmit through the Site any information that you do not have a right to make available (such as the intellectual property of another party); (iv) upload to, post on, or transmit through the Site any material that contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; (v) take any action that imposes or may impose (in China TransInfo’s sole discretion) an unreasonable or disproportionately large load on China TransInfo’s infrastructure; (vi) enter information or download information from the Site through any means other than direct user interaction with the pages on the Site (for example, but not as a limitation, “screen scraping” is expressly prohibited); (vii) make any use of data mining, robots, scrapers, spiders or similar data gathering and extraction tools; (viii) obtain or attempt to obtain access to any portion of the Site or any portion of the Content that have not been made accessible through a visible link on the Site. The license is further limited in that you: i) may not bypass any technical or other measures used by China TransInfo to prevent or restrict access to the Site; ii) agree not to use the Site or the Content for any unlawful purpose; iii) may not bring up or present any page or Content from the Site within another site (“framing), except with China TransInfo’s express, prior written consent; and iv) may not archive, cache, or mirror any portion of the Site or any Content. Any unauthorized use of the Site or any Content by you shall terminate the permission or license granted to you by China TransInfo and will make any further use of the Content or the Site an infringement of China TransInfo’s copyrights and/or other intellectual property rights. All rights not expressly granted under this Terms of Service are reserved by China TransInfo. No license express or implied is granted unless expressly set forth in this Terms of Service.
China TransInfo reserves the right, without prior notice, to amend, supplement or delete either permanently or temporarily any information or may suspend its publication in part or in its entirety.
If China TransInfo modifies this Terms of Service, it will notify you, with a notice displayed at the top of this Terms of Service deemed sufficient notification, of such changes. If you choose to continue using the Site, you agree that by doing you will be deemed to accept the new Terms of Service.
3. Disclaimer of Warranty.
China TransInfo does not warrant, guarantee or represent in any form or manner that the Site or the Content is complete, accurate or up to date. AS BETWEEN YOU AND CHINA TRANSINFO, ALL PRODUCTS, CONTENT AND SERVICES ON THE SITE ARE PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF ANY KIND EITHER EXPRESS OR IMPLIED INCLUDINGTHE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ANTI-VIRUS, SECURITY OR ACCURACY. The Content is not a substitute for legal, investment or tax advice.
4. Limitation of Liability.
You expressly understand and agree that China TransInfo and its subsidiaries, affiliates, officers, employees, agents, partners and licensors are not (collectively or individually) liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including damages for loss of profits, goodwill, use, data or other intangible losses (even if China TransInfo has been advised of the possibility of such damages), resulting from use of the Site, Content, any related services or any information provided, including damage relating to incomplete information, in particular, but not limited to, in cases where gross negligence or deliberate action cannot be proven on the part of China TransInfo. No liability will be accepted for any loss or damage howsoever arising from or in reliance upon the Content of this Site.
